GUN CASES

In Illinois it is a felony to carry a gun on your person or in your car. Also, if you are already a convicted felon, you are not allowed to have a gun even in your house. As you can see below, we win most of these cases by showing that the police search was unconstitutional. If we can show that the police acted improperly we will get your case dismissed.

People v.  Roman - Aggravated UUW, 09CR-16063
NOT GUILTY  Bridgeview Courthouse
Chicago Police pulled over a car in which our client was a passenger. The police claimed a gun found in the car belonged to our client. Police even put a statement on our client, where they claimed our client said he owned the gun. We took the case to trial and the judge did not beileve the gun belonged to our client, or that our client made the statement. The Judge found our client not guilty.

People v.  Dondle - UUW by a Felon, 09CR-1668
NOT GUILTY  26th and California
Chicago Police executed a search warrant at a house they claimed our client lived in and found a gun. The police arrested our client when he showed up at the house later that day. We took the case to trial and proved that our client did not live in the house, and did not own the gun. The Judge found our client Not Guilty.


People v.  Pennington - Aggravated UUW, 09CR-16060
DISMISSED  Bridgeview Courthouse
Chicago Police arrested our client and searched his car for a minor traffic violation. Our client was from Indiana and had a permit to carry a gun. Unfortunately, the permit was not valid in Illinois. We filed a motion to quash and surpress, claiming the police had no right to search the car. The Judge agreed and all felony charges were dismissed.

Our client and several of his friends were standing on a porch. Chicago Police came up to the porch and detained everyone. Police found three guns, and claimed that one belonged to our client. We took the case to trial and proved that our client did not possess the gun, and the Judge found him Not Guilty.

People v.  Carvajal - Aggravated UUW, 08CR-22724

Chicago Police claimed they saw our client fighting with someone on a street corner. The police testified that as they approached, our client ran and dropped a gun to the ground. We took the case to trial and proved through several witnesses that the story the police told was not true. The Judge found our client not guilty of possessing the gun. 

People v.  Woods - Aggravated UUW, 04CR-9638
DISMISSED  Markham Courthouse
Police officers stopped our client's vehicle for improper parking and then searched the vehicle and located a gun.  We filed a motion to suppress evidence on the basis that the police had no right to search the vehicle.  The Court agreed and granted the motion. The State was forced to dismiss the case.  We filed an expungement petition and cleaned our client's record.

People v.  Green - Unlawful Use of Weapon (UUW), 05CR-15507

Police claimed they saw our client drop a gun on the street, and after they arrested him, our client allegedly gave consent for the Police to search his home where other guns were found. After a hearing on our Motion to Suppress, the Judge said that the Police lied and threw out all the evidence.

People v.  Nassir - Unlawful Use of Weapon (UUW), 06CR-14732

At a hearing on a Motion to Suppress, the Police testified that our client gave them consent to search the car. The Judge ruled that the Police's story was not believable, and threw out the gun as evidence based on our presentation of new case law showing the stop was unconstitutional.

People v.  Brooks - Unlawful Use of Weapon (UUW), 06CR-16049

The Chicago Police accused our client of confronting his wife and her current boyfriend with a gun. After the fight broke-up, the Police arrived and found a gun at the scene. After JURY TRIAL our client was found NOT GUILTY.

People v.  Echols - Unlawful Use of Weapon (UUW)
DISMISSED  26th and California

Chicago Police set-up a road block and picked-out our client for a stop. Police illegally searched our client's car and found a gun. We showed the search was unconstitutional and the case was dismissed.
